Privacy Policy
1. Introduction
Marque Talent (we, us or our) respects your privacy and is committed to protecting the personal information we handle. This Privacy Policy explains how we collect, use, hold, disclose and protect personal information, and how you can access and correct your information or make a complaint.
We handle personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs), and we treat the Act as applying to us in full. This Policy governs personal information we collect through our website, by phone or email, at meetings and interviews, through referrals, and in the course of providing our recruitment and talent advisory services.
2. The Two Ways We Handle Personal Information
As a talent acquisition consultancy, we handle personal information in two distinct capacities, and it is important to understand the difference:
- Information we collect and manage directly. This includes information about website visitors, enquirers, prospective and current client contacts, referees, and suppliers. This Policy governs how we handle that information.
- Candidate information we handle in the course of recruiting for clients. When we recruit for a client, we collect and assess candidate information (for example resumes, screening notes, assessment results and reference checks) in order to present suitable candidates to that client. We disclose a candidate's information to a prospective employer only with the candidate's consent, confirmed before they are presented. Once a client receives candidate information, their own privacy practices also apply to their copy of it.
3. The Kinds of Personal Information We Collect
Depending on your relationship with us, the personal information we collect may include:
- contact and identity details, such as your name, email address, phone number, job title and employer;
- information you provide through website forms, communications, meetings or when using our services;
- recruitment and employment information, such as resumes, work history, qualifications, salary expectations, references and eligibility-to-work details;
- interview, screening and assessment information, including notes and outcomes recorded against role criteria;
- background-check information, where you have consented to a pre-employment or other authorised check (for example police, Working With Children, qualification or visa checks);
- technical information collected automatically when you use our website (see the section on cookies and analytics below); and
- records of our dealings with you, including correspondence and service history.
4. Sensitive Information
Some of the information we handle is "sensitive information" under the Privacy Act, for example health information or criminal history obtained through an authorised check. We only collect sensitive information where you have consented, or where the collection is otherwise required or authorised by law, and we use and disclose it only for the purpose for which it was collected or a directly related purpose you would reasonably expect.
5. How We Collect Personal Information
We collect personal information directly from you wherever practicable, for example when you contact us, complete a form, engage our services, or apply for a role. In some cases we collect information from third parties, such as job platforms you have applied through (for example Seek or LinkedIn), referees you nominate, screening and check providers you have authorised, publicly available professional sources, or a client who engages us in relation to a role. Where we collect information from a third party, we take reasonable steps to ensure you are made aware of the collection.
6. Anonymity and Pseudonymity
Where it is lawful and practicable, you have the option of dealing with us anonymously or by using a pseudonym, for example when making a general enquiry. In most cases, however, we will need to identify you in order to provide our services or respond properly to your request, and recruitment services cannot be provided anonymously.
7. Why We Collect, Hold, Use and Disclose Your Information
We collect, hold, use and disclose personal information for purposes including:
- assessing candidates' suitability for roles and presenting them to clients, with the candidate's consent;
- managing recruitment campaigns, communicating about opportunities, and arranging interviews, references and checks;
- providing talent advisory services to clients;
- responding to your enquiries and communicating with you;
- administering our client relationships, invoicing and account management;
- improving our website, services and client and candidate experience; and
- meeting our legal, regulatory and record-keeping obligations.
8. Disclosure of Personal Information
We do not sell your personal information. We may disclose personal information to:
- a client, where we are presenting you as a candidate for a role, and only with your consent;
- referees and screening or background-check providers, where you have authorised the relevant check;
- third-party service providers who help us deliver our services (for example IT, cloud hosting, email, document and AI-assisted drafting platforms), who are required to protect your information and use it only for the purposes for which we engage them; and
- others where required or authorised by law, or with your consent.
9. Overseas Disclosure
Some of the third-party providers we use may store or process personal information outside Australia. This commonly includes providers located in countries such as the United States, where major cloud and software providers operate. Where we disclose personal information to an overseas recipient, we take reasonable steps, consistent with APP 8, to ensure the recipient handles the information in a way consistent with the Australian Privacy Principles.
10. Direct Marketing
We may send you updates and communications about our services where you would reasonably expect us to, or where you have consented. Every marketing email includes a simple way to opt out, and you can also unsubscribe at any time by contacting us. We will action opt-out requests promptly and will not use your information for direct marketing after you opt out (though we may still contact you about services you are receiving).
11. Cookies, Analytics and Our Website
Our website uses cookies and similar technologies to help it function, remember your preferences and understand how the site is used. We may use analytics tools and social media links (including platforms such as LinkedIn) that can collect information about your visit. You can control or disable cookies in your browser settings, although some parts of the website may not work as intended if you do.
12. How We Store and Protect Your Information
We take reasonable technical and organisational steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These measures include access-controlled cloud services, multi-factor authentication, and secure systems and practices. No method of transmitting or storing data is completely secure, so while we work hard to protect your information, we cannot guarantee absolute security.
13. Data Retention and Destruction
We keep personal information only for as long as we need it for the purposes described in this Policy, or as required by law. When personal information is no longer needed and we are not required to retain it, we take reasonable steps to destroy it or de-identify it.
14. Data Breaches
We maintain processes to identify and respond to data breaches. If we experience an eligible data breach that is likely to result in serious harm to affected individuals, we will assess the breach promptly and notify affected individuals and the Office of the Australian Information Commissioner (OAIC), as required under the Notifiable Data Breaches scheme in the Privacy Act. Where a breach affects information we handle in connection with a client engagement, we will also notify and work with that client so each of us can meet our obligations.
15. Automated Tools and Decision-Making
We use AI tools to assist with drafting documents and organising and rating candidate information against role criteria. All decisions that affect an individual, including whether a candidate is shortlisted, presented or declined, are reviewed and made by a human. In line with our transparency obligations under the Privacy Act, we disclose that computer programs assist in these processes, and you may ask us how automated tools were used in relation to your information.
16. Accessing and Correcting Your Information
You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete or misleading. Please contact us using the details below. We will respond within a reasonable time, usually within 30 days, and may need to verify your identity first. There is generally no charge for a request, although in limited circumstances we may decline (for example where the law requires or permits us to), and if so we will explain why.
17. How to Make a Privacy Complaint
If you believe we have mishandled your personal information or breached the Australian Privacy Principles, please contact us using the details below so we can address it. We will acknowledge your complaint promptly and aim to respond within a reasonable time, usually within 30 days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992.
18. Changes to this Policy
We may update this Privacy Policy from time to time. The current version will always be available on our website, and the effective date is shown at the top. We encourage you to review it periodically.
